    Terms and Conditions

     

    1. The Promotion

    1. Entry into the ‘HOYTS Rewards – Chance To Win* $500’ promotion (Promotion) is deemed acceptance of these Terms and Conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.
    2. Australian entries must be submitted from 11/09/2024 until 11.59pm 13/10/2024 AEST (Promotion Period).
    3. New Zealand entries must be submitted from 11/09/2024 until 11.59pm 13/10/2024 NZST (Promotion Period).
    4. The Promotion is a game of chance.

    2. Promoter’s Details

    The Promoter is The HOYTS Corporation Pty Ltd of 680 George St Sydney, NSW, 2000 (Promoter) (ABN 31 006 082 551). The Promotion is authorised under NSW authority no: TP/03153.

    3. Eligibility

    1. Entry into the Promotion is open to Australian and New Zealand residents 18 years of age or older who is a HOYTS Rewards member and has their communication preferences turned on, excluding HOYTS directors, management, employees and their immediate families and its related bodies corporate. A person under 18 may enter with the permission of their parent or guardian.
    2. The Promoter reserves the right to verify the validity of each entry. The Promoter reserves the right to disqualify any person for tampering with the entry process or who otherwise does not comply with these Terms and Conditions.

    4. Entry into the promotion

    1. To enter;
      1. Eligible entrants will automatically receive an entry into the competition when they successfully enter the secret code word found in the HOYTS Rewards weekly newsletter email (sent each Wednesday) at  hoyts.com.au/secretcode (AU) or hoyts.co.nz/secretcode (NZ) , during the promotional period. One entry per Newsletter send. Entrants can only enter once per week during the promotional period.
      2. Entrants must be a HOYTS Rewards Member, have their communication preferences turned on for at least the duration of the competition, and enter the secret code word correctly.
      3. The Promoter is not responsible for any lost, late or misdirected entries.

    5. The Prize

    1. The Promoter is offering Entrants the chance to win one (1) of five (5) $500 Mastercard or Prezzee digital e-gift cards per week.
    2. The maximum notional value of the prize is $500 with a total prize pool of $2,500.
    3. Each winner will receive five hundred dollars ($500). The Prize value is in Australian Dollars for Australia, and New Zealand Dollars for New Zealand. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
    4. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not exchangeable or redeemable for other goods or services. The prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting the prize that the winner accepts the conditions of use of the prize.
    5. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

    6. Drawing of entries

    1. The competition draw will take place at The HOYTS Corporation Pty Ltd of 680 George St Sydney, NSW, 2000 on each Monday during the promotional period – 16/09/2024, 23/09/2024, 30/09/2024, 07/10/2024, 14/10/2024 at 10am AEST. The draw will be conducted by The HOYTS Corporation Pty Ltd (Drawer).
    2. The result of the draw is final and no correspondence will be entered into.
    3. Any unclaimed prizes remaining after the Promotional Period has ended will be distributed via a second-chance draw. The second-chance draw will be conducted at 10:00am on 28/10/2024 at the HOYTS Sydney Head Office, located at Level 50, 680 George Street Sydney, NSW 2000, and any remaining prizes will be distributed on this date. Winning customers will be notified via email.

    7. Notification of the winner

    The winners will be notified by email within two (2) business days of the draw and their names will be published on the HOYTS website https://www.hoyts.com.au (AU) and https://www.hoyts.co.nz (NZ) from 17/10/2024 for a period of 28 days.

    8. Prize Details

    1. Following the relevant Winner’s announcement, the prize will be sent to the Prize Winner via email within 4 weeks of the final prize draw.
    2. The Promoter is not responsible thereafter for the manner in which the prize is redeemed or credited. Mastercard or Prezzee Gift Card awarded must be redeemed, in accordance with and subject to the Terms and Conditions of the Gift Card.

    9. Other Matters Relating to the Promotion

    1. If a Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax.
    2. The Promoter’s decision is final and no correspondence will be entered into.
    3. Subject to applicable legislation and (if required) the approval of any relevant authorities, the Promoter reserves the right to substitute the Prize in whole (or any of its components), with a substitute prize of equal or greater value and the Prize Winner will be notified accordingly.

    10. Privacy

    By entering this Promotion, each Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the Promotion and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the Promotion to third parties as required by law. If the information requested is not provided by the Entrant, the Entrant may not participate in the Promotion.     11. Liability

    1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under Australian Consumer Law, or the Consumer Guarantees Act 1993 (New Zealand). Except for any liability that cannot by law be excluded, the Promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all:
      1. liability for all direct losses arising in any way out of out of: (i) any technical difficulties, equipment malfunction, any delayed email, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical problems or traffic congestion on the internet or any website (whether or not under the Promoter or its related bodies corporates’ control); (ii) any theft, destruction, unauthorised access or third party interference of entries under this Promotion; (iii) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or its related bodies corporate; (iv) any tax liability incurred by a Prize Winner or Entrant; or (v) use of a Prize; and
      2. Liability for indirect or consequential losses arising in any way out of the Promotion.

    12. Variations

    1. Subject to applicable law, the Promoter reserves the right at its sole discretion to modify, suspend or terminate all or part of the Promotion, or disqualify and prohibit further participation in this Promotion, in the event that any portion of this Promotion is compromised by a virus, bugs, non-authorised human intervention, hackers or other causes beyond the reasonable control of the Promoter which, in the sole opinion of the Promoter, corrupts or impairs the administration, security, fairness, or proper conduct of the Promotion.
    2. The Promoter reserves the right to update these Terms and Conditions from time to time in its sole discretion for administrative reasons or to ensure efficient operation of the Promotion. Changes will be posted on the Promoter’s website at https://www.hoyts.com.au / https://www.hoyts.co.nz.

    13. General

    1. Failure by the Promoter to enforce any one of these Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any Entrant or Prize Winner or other person.
    2. The laws of the State where an Entrant is based apply to this Promotion and in the case of New Zealand Entrants, the laws of New Zealand apply.
